TuneSolo General Terms of Use

• 1. Using the Service
  • Eligibility.You must be at least 13 years of age to access or use the TuneSolo Service. If you are under 18 years of age (or the age of legal majority where you live), you may use the TuneSolo Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian of a user under the age of 18 (or the age of legal majority), you agree to be fully responsible for the acts or omissions of such user in relation to the TuneSolo Service.
  • Access to the Service. Subject to your compliance with these Terms, you are granted a non-exclusive, limited, non-transferable, freely revocable license to access and use the Service for personal use. TuneSolo reserves all rights not expressly granted under these Terms. Each person must have a unique account and you are responsible for any activity conducted on your account. Account credentials may not be shared or transferred. We reserve the right to block or suspend any Registered User’s use of the Site and the services on it without reason but expressly including if we think that they are violating these terms & conditions, legal liabilities (actual or potential), infringing someone else’s intellectual property rights, engaging in fraudulent, immoral or illegal activities, or for other similar reasons.
  • Restrictions on Use of the Service. You shall not yourself or through any third party (i) rent, lease, sell, distribute, offer in a service bureau, sublicense, or otherwise make available the Service or the Licensed Content to any third party (except as permitted under these Terms); (ii) copy, replicate, decompile, reverse-engineer, attempt to derive the source code of, modify, or create derivative works of the Service, or any part thereof; (iii) access the Service for purposes of performance benchmarking; (iv) access the Service for purposes of building or marketing a competitive product; (v) use the Service to store or transmit a virus or malicious code; (vi) use a virtual private network (VPN) to circumvent geographic-based pricing or content access; (vii) use the Service to transmit unsolicited emails or engage in spamming; (viii) use any form of data mining, extraction, or scraping on the Service and/or the contents available therein for machine learning or other purposes; or (ix) bypass the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the Licensed Content. All rights not expressly granted in these Terms are reserved by us.
  • Availability. Our webpages may be accessible worldwide, but this does not mean all Services and Software are available in your country or that User-generated content available via the Services and Software is legal or available in your country. Access to certain Services (or certain Service features) or Software in certain countries may be blocked by us or foreign governments. It is your responsibility to make sure your use of the Services and Software is legal or available where you use them. Services and Software are not available in all languages.
• 2. Billing

  TuneSolo offers a free and paid Service. Pricing may vary by location and will be based on the billing information you provide us at the time of purchase.

  • Subscriptions and Renewals.If you are subscribing to TuneSolo, you can sign up for either a monthly, annual or lifetime subscription. Your subscription will automatically renew on a monthly or annual basis as applicable. You can cancel your subscription at any time. If you cancel your subscription, you will not receive a refund or credit for any amounts that have already been billed.
  • Taxes Your subscription fees are inclusive of all taxes unless otherwise specified in an agreement with TuneSolo, within the Service or on an applicable invoice. Tax rates are calculated based on the billing information you provide and the applicable tax rate at the time of your subscription charge.
  • Cancellation. You can stop using the Service and/or cancel your subscription at any time by emailing us. If you cancel your subscription, you will not be entitled to a refund of any fees already paid.
  • Free Trials. TuneSolo may offer you a free trial or pilot to allow you to try our Service. TuneSolo reserves the right to set eligibility requirements and the duration for free trials and pilots. Your access to the Service will cease if you do not enter into a paid subscription prior to the end of the pilot period.
  • Changes to Pricing. TuneSolo reserves the right to change its prices at any time. If you are on a subscription plan, pricing changes will not apply until your next renewal or thirty (30) days after notice, whichever is later.
  • Billing Communications. You agree that TuneSolo may contact you at any time by email or other method with information relevant to your subscription, billing, and use of the Service.
• 3. Feedback

  In the event that you provide us with any questions, comments, suggestions, opinions, observations, usage information, or feedback for TuneSolo App and Service, including ideas for improvements, enhancements and other changes (collectively the “Feedback”), you agree that we are the owner of such Feedback, and we are free to use it for our business purposes, including by incorporation into the Services and Software without any payment or attribution or other obligation to you. You warrant that you own all the rights and interests in and to the Feedback and you hereby assign all the rights and interests in and to the Feedback to TuneSolo.

• 4. Privacy

  Please refer to our Privacy Policy below for information about how we collect, use and disclose information about you.

• 5. Ownership, Trademarks

  Ownership of the TuneSolo App and Service, and all content and materials contained therein other than any User Content (as defined below), are owned solely by us or our licensees and are protected by U.S. and international copyright laws. No title to or ownership of the Site, the App, the TuneSolo Service or any proprietary rights associated with them is transferred to you by these Terms. TuneSolo and our logos, our product or service names, our slogans and the look and feel of the TuneSolo Service are our trademarks and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned on the TuneSolo Service are the property of their respective owners. Reference to any products, services, processes or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by us.

• 6. Limitation of Liability

  In no event shall either party’s aggregate cumulative liability hereunder (whether in contract, tort, negligence, strict liability in tort or by statute or otherwise) exceed the greater of (i) $100 USD or (ii) the subscription fees paid by you to TuneSolo during the twelve-month period preceding the event or occurrence giving rise to such liability. The foregoing limitations shall not apply to liabilities arising out of your indemnification obligations or your breach of the section entitled ‘restrictions on use of the service.’

  In no event shall either party be liable for any consequential, incidental, indirect, special, exemplary or punitive damages, losses, or expenses (including but not limited to business interruption, lost business or lost profits) even if it has been advised of their possible existence and notwithstanding the failure of essential purpose of any remedy. The foregoing limitations shall not apply to liabilities arising out of your indemnification obligations or your breach of the section entitled "restrictions on use of the service."

  TuneSolo is not responsible for, and assumes no liability for, the contents of User Content.

  These terms do not affect consumer rights that cannot by law be waived or limited. These terms do not exclude or limit liability arising out of either party’s gross negligence, fraud or willful misconduct.

• 7. Term and Termination
  • Term.These Terms shall take effect the first time you access the Service and shall continue in full force and effect until i） if you are a paid subscriber, the expiration or termination of your subscription; or ii） if you are using TuneSolo’s free offering, when your account is deleted or terminated.
  • Violations. If TuneSolo, in its reasonable discretion, determines that you or your use of the Service, your User Content, or your Designs violate these Terms, TuneSolo may take one or more of the following actions: (i) delete the prohibited Downloaded Content; (ii) suspend your access to the Service; (iii) terminate and delete your account along with all Downloaded Content associated with that account (iv) permanently ban you from using the Service.

  If you break the rules, we have the right to remove you and everything in your account from the Service.

  • Effect of Termination.In the event of a termination of your subscription to a violation by you, you will not receive any refund and shall immediately pay any outstanding fees for the remaining period of your subscription.

  Upon any expiration or termination of your Subscription, you must cease using the Service. You will lose access to your Account, Downloaded Content, and any other information uploaded to the Service (and we may delete all such data unless legally prohibited) after expiration or termination of Your Subscription. Unless your account was terminated due to a Violation, you can download or export your Downloaded Content using the functionality of the Service prior to the expiration or termination of your subscription.

  • Survival of Terms.Sections titled "Term and Termination," "Billing," "TuneSolo’s Intellectual Property," "Limitation of Liability," "Indemnification," and more inclusive, shall survive any expiration or termination of these Terms.
• 8. Indemnification Obligations

  You agree to indemnify and hold our subsidiaries, affiliates, officers, agents, partners and employees harmless from any loss, liability, claim or demand (including legal fees) arising directly or indirectly from your use of the Site and/or our services, any breach or alleged breach by you of these terms or of use or any representations or warranties made by you or that you give during any application process to become a Registered User.

TuneSolo Privacy Policy

• 1. Information We May Collect from You

  We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Information you provide us directly.We may ask for certain information when you register for a TuneSolo account or correspond with us (such as a username, your first and last names, birthdate, phone number, profession, and e-mail address). Additionally, if you subscribe to TuneSolo, we collect details about your subscription like the type, duration, cost, and start date of your subscription, and we work with a third-party payment processor to collect and process your payment information.

  We also collect any messages you send us through the Service (such as user feedback, search queries and prompts), and may collect information you provide in User Content you post to the Service (such as audio files you upload to convert). We use this information to operate, maintain, improve and provide the features and functionality of the Service to you, to correspond with you, and to address any issues you raise about the Service.

  If you don’t provide your personal information to us, you may not be able to access or use our App and Service or your experience of using our Service may not be as enjoyable.

  • Information we receive from other sources. We obtain information from other sources. For example, we may collect information from social networks, advertising networks, internet service providers, and data analytics providers. This information includes handles, content, and other information shared with us through third-party features that you use on the TuneSolo App or Service or posted on social media pages (such as our social media page or other pages accessible to us). If you communicate with us via social media, including Instagram, Facebook or TikTok and choose to share your content with us, we may receive information such as audio you’ve created, your account name and your comments about TuneSolo.
  • Cookies information and information taken from similar technologies. When you visit the Service, we will send cookies — small text files containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets TuneSolo do things like help you log in faster, enhance your navigation through the site, remember your preferences and generally improve the user experience. Cookies also convey information to us about how you use the App and Service (e.g., the pages you view, the links you click and other actions you take on the App and Service), and allow us to track your usage of the Service over time.

  You can control or reset your cookies and similar technologies through your web browser, which will allow you to customize your cookie preferences and to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.

  • Log file information. Log file information is automatically reported by your browser or desktop device each time you access the App and Service. When you use our App, our servers automatically record certain log file information.
  • Location data. TuneSolo may collect and use your location data for personalization, analytics, advertising and tax purposes. TuneSolo may collect your precise or approximate location:
  • from you, when you provide, correct or confirm your location (e.g., when you purchase products from us);
  • by inferring your location from your IP address;
  • from our partners or your payment provider.
  • Content within your account. We receive content that you create within your TuneSolo account and media you upload for use within it, and metadata about your content.
• 2. How We Use Your Information?

  We use the information we collect about you for the purposes set out below:

  • To provide you with the Service.We use the information that you directly give us to provide the App and Service to you. This includes allowing you to log in to TuneSolo, operating and maintaining the Service, giving you access to your music library and billing you for transactions that you make via the Service. We also use information we collect about you automatically to remember information about you so that you will not have to re-enter it during your visit or the next time you visit the site or app.
  • To administer and protect our Service and the Applications. We use information about you to help us improve the TuneSolo Service and our users’ experience, including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data.
  • To manage our relationship with you. We may use your personal information to ask for your feedback or to ask you to participate in surveys. We also use information we collect about you to make sure that you get the most relevant offers and promotions based on your use of the Service, and your preferences.
  • To deliver relevant advertisements. We use information about you, including cookies information and other information we (and our third-party partners) collect from you automatically about your use of the Service, to serve, personalize and measure the effectiveness of advertising on the Service and third-party sites and platforms. This includes showing you advertising we think you might find interesting as well as displaying advertising to potential new users that have similar interests.
• 3. How Do We Share Personal Data with Third Parties?

  We may disclose personal data relating to you to third parties in certain circumstances, including (but not limited to) the following:

  • We might share some information about you with our business partners and third-party service providers in order to provide the Service to you or to fulfill TuneSolo’s legitimate business interests;
  • Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others, where we have your permission for this;
  • Analytics and search engine service providers that assist us in the improvement and optimization of this Website;
  • If we sell our business, any of the info that we’ve acquired about you may be part of the sale;
  • We may share data with authorities under our Authority Request Policy or where we feel it is necessary.

  Before TuneSolo discloses any personal data to a third party, we take steps to ensure that the third party will protect personal data in accordance with applicable privacy laws and in a manner consistent with this policy. Third parties are required to restrict their use of this information to the purpose for which the information was provided.

• 4. How Do We Protect Personal Data?

  TuneSolo cares about the security of your information, and uses appropriate safeguards to preserve the integrity and security of all information collected through the Service. All information you provide to TuneSolo is stored on secure servers. Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted using industry-standard encryption technologies when transferring or receiving personal data, such as SSL technology.

  The safety and security of your information and any personal data relating to you also depends on you. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from TuneSolo, at all times. However, TuneSolo cannot ensure or warrant the security of any information you transmit to TuneSolo or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. TuneSolo is not responsible for the functionality or security measures of any third party.

• 5. Links to Third-Party Sites

  The Site may, from time to time, contain links to and from the websites of our partners, advertisers and associates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for the protection of any data supplied to other sites.

• 6. Advertising

  We partner with third-party ad servers, ad networks, and social media platforms (like Facebook, Google, TikTok, and YouTube) to deliver personalized advertisements (“ads”) on our Service and other sites that may be of interest to you and/or to measure their effectiveness, and/or to identify potential new users of our Service.

  TuneSolo may share certain information with our third-party advertising partners, and allow partners to perform a match of your information against information from other third-party networks or sites to serve ads either on the Service or on third-party sites and to measure the effectiveness of these ads.

  TuneSolo does not sell or rent the information we collect directly from you or about you from third parties with these third-party ad servers or ad networks for such parties’ own marketing purposes.

  The TuneSolo Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers or contact such advertisers for more information.

• 7. Changes to This Policy

  We may update this policy from time to time to reflect our current practice and ensure compliance with applicable laws. When we post changes to this policy, we will revise the “Last Updated” date at the top of this policy. If we make any material changes to the way we collect, use, store and/or share your personal information, we will notify you on our website or by sending an email to the email address associated with your TuneSolo account.
